Terms and Conditions

GENERAL CONDITIONS

These conditions are intended to define the General Sales Conditions between LISMÂNIA and the B2B store User. The company's opening hours are from Monday to Friday from 8:30 am to 12:30 pm and from 1:30 pm to 5:30 pm.

The prices shown do not include VAT and are subject to change without notice. The agreed discounts or net prices are displayed in each customer's private area.

 

As a registered Customer, you can place your orders in your private area of our B2B platform at www.lismania.com. For certain products, minimum quantities may be required order.

Your order may be conditionally registered or pending approval in the event of:

•    Account limit
•    Pending invoices
•    Unavailable stock
•    Price change

In any of the aforementioned cases, the customer will be informed by LISMÂNIA commercial services of the definitive registration or cancellation of their order by email.
 

In case of cancellation or modification of the order, the Customer must send an email to comercial@lismania.com or a message in the “Communication” tab of their customer area, within 6 hours after registrating the order. If the order has already been shipped, cancellations or modifications will not be accepted.
 

For the Portuguese market, registered orders will be shipped within 24 to 48 hours after registration, or on the date determined by the customer at checkout. Shipments to other countries will be handled directly with the customer.

In case of rupture of stock, the customer will be informed via e-mail by our commercial department of the probable date of availability of the missing items/quantities. In this case, the order will be partly shipped, with the pending items being shipped the date communicated. If the customer wishes to carry out the order only in its entirety, he must expressly communicate this to our commercial department.

 

Deliveries in mainland Portugal for purchases over €250 (value without VAT) are free. For purchases of less than €250 (value without VAT), shipping costs are €4.50 (value without VAT) unless the goods are picked up at our facilities. Shipments to other countries will be handled directly with the customer.

 

The risk for loss and/or damage is transferred to the Customer from the moment the goods are sent to him. LISMÂNIA does not assume responsibility for damage caused during transport, and the customer must ensure that the goods are in perfect condition upon receipt, safeguarding any anomaly in the carrier's proof of delivery.

 

The Customer, after receiving the products, has a period of 5 working days to send LISMANIA any complaint regarding the product received. After this period, the products will be considered in compliance.
The complaint must be sent to LISMÂNIA after completing the RMA in PDF format.

LISMÂNIA reserves the right to reject possible returns when the merchandise is in poor condition, due to misuse or transport damage.

Transport costs related to the RMA are shared between the Customer and LISMÂNIA. The Customer will ship the material to LISMÂNIA postage prepaid and LISMÂNIA will return the repaired/replacement material postage prepaid. The return of non-defective merchandise will only be carried out with the approval of the LISMÂNIA Commercial Department. Only with the completion and sending of the RMA (accompanied by proof of purchase) is the return considered accepted. The RMA number will be assigned later by LISMÂNIA. In the event of a return due to the Customer's error, an extra cost for management and administration costs will apply.

Returns are only accepted in the following cases:

1.    Defective equipment 
Defective equipment at reception:
If the equipment/tool is defective when the Client receives it, it must be returned to LISMÂNIA in its packaging, with original manuals and accessories.

2.    Non-conforming product
If the product does not conform to the respective product data sheet (LISM043) or does not correspond to the technical characteristics, it must be returned to LISMÂNIA in its original packaging.

 

The equipment sold by LISMÂNIA complies with the mandatory guarantees provided for by law, in addition to benefiting from the guarantee conditions offered by the respective manufacturers, and only these must be held responsible for their compliance. Technical assistance is provided by the brands themselves. Under the guarantees, the Customer must note the equipment's serial number and keep the purchase document, to present in the event of a claim. LISMÂNIA is not responsible for damages resulting from improper use of the products it sells.

 

LISMANIA offers its customers three forms of payment:

• Bank transfer
• Check
• Charge on delivery

The payment method and conditions will be agreed between LISMÂNIA and the Customer when opening na account to the B2B platform. In case of bank transfer, payment can be made to one of the following bank accounts:

For charge on delivery, only cash for the exact amount of the invoice is accepted. A check made out to LISMÂNIA Ferragens e Decorações, Lda is also accepted. Failure to settle invoices within the due dates implies the payment of interest under the legal terms and rates in force, as well as all expenses necessary for their litigation collection in accordance with the Law.

 

When making a purchase on our B2B platform, the User expresses its full and complete acceptance of these general conditions of sale, prices and description of the products included in the transaction. In everything that is not properly provided for in these General Sales Conditions, the procedural and substantive legal provisions in force will apply, in particular, Directive 97/7/EC of the European Parliament and of the Council, of 20 May 1997, Decree-Law no. 24/2014, of 14 February and the Civil Code.

Any conflict or divergence in the interpretation of the General Contracting Conditions will be submitted to the competent Portuguese Court, Santo Tirso being the chosen forum, with express waiver of any other.

 

LISMÂNIA reserves the right to proceed unilaterally and without any prior notice to change or revoke these General Sales Conditions.
